Truck Accident Lawyer Tips – Tractor-Trailer Crash on I-95 Causes Two Deaths

Be alert and aware when driving.

Unfortunately, this warning came too late for two people in Dunn, North Carolina. On January 12, 2010, Bert Baytops of Newark, New Jersey and a female companion were fatally injured on Interstate 95 when apparently the driver fell asleep at the wheel. The car ran off the road and hit a guard rail and shot back on to the roadway where it rolled to a stop. A tractor trailer driving in the same direction unknowingly came upon the scene and could not stop in time before smashing into the car still in the middle of the roadway. The force of the impact caused the passenger to be thrown from the car. The car blew up with the driver still behind the wheel of the car. Interstate 95 was closed for over five hours.

Truck Accident Lawyer Tips – Driver Falls Asleep at the Wheel and Ends up Under a Tractor-Trailer

On June 2, 2009, Christine Osterholtz of Lakeland, Florida was heading eastbound on Interstate 4 when she fell asleep. She was traveling in the center lane and her vehicle drifted into the far right lane into the pathway of a tractor trailer being driven by Michael Dacunto of Spring Hill. The impact to the left side of the truck caused both vehicles to slide across the entire breadth of I-4 and land on top of the guardrail separating them from the oncoming traffic. The tractor trailer flipped sideways and landed on top of Christine’s car pinning her and her car completely under the truck. Luckily the both drivers were taken to Lakeland Regional Medical Center with minor injuries.

Truck Accident Lawyer Tips – Explosion at Orangeburg, South Carolina Trucking Company Takes the Lives of Two Employees

Two employees were killed and a third injured in an April 22 fueling mishap at Rutland Timber and Trucking, a company near Orangeburg, South Carolina. The employees were using a homemade fuel pump powered by the truck’s battery to move diesel fuel from a storage tank to a truck – when a massive explosion was touched off. The Orangeburg County Sheriff’s Department and SLED (the State Law Enforcement Division) investigators have since determined that the diesel fuel contained an amount of gasoline. This cleared up one part of the investigation – diesel fuel alone is generally considered incapable of exploding. Still unanswered is how the gasoline came to be mixed with the diesel fuel. Thanks to the Orangeburg Times and Democrat for reporting. Our hearts go out to those who lost loved ones in this tragedy.

Truck Accident Lawyer Tips – Fatal Truck Accident in Raleigh, North Carolina

A single vehicle incident on Interstate 40 in Raleigh, North Carolina, claimed the life of the driver of a tractor-trailer on April 27. The truck and box trailer burned after coming to rest at the outside shoulder. Several brave witnesses tried to rescue the driver from the wreckage, but were unable to free him before the fire engulfed the truck. Photographs from the scene show skid marks leading up to a jackknifed tractor-trailer. This suggests the driver may have slammed on his brakes, which may have led to the trailer jackknifing into the fuel tank. Authorities are still investigating the cause of the incident, however. Thanks to The News & Observer and WTVD for reporting.

What You Need to Do if You are Involved in a Tractor Trailer Accident

tractor trailer accident lawyers, georgia tractor trailer accident lawyersThe odds are against you when you’re involved in a collision with a semi tractor trailer.First, if you’re occupying a car, riding a bike or walking, you’re likely to be seriously injured or killed.Second, if the collision was caused by a truck driver or truck owner’s negligence, you face an uphill battle to ensure that the negligent driver and his employer compensate you fairly for your damages including medical bills, lost wages, and pain and suffering. Why? The truck driver and his company have an overwhelming advantage. They have decades of experience defending claims just like yours. They have risk management departments dedicated to denying claims and minimizing payouts. They have attorneys ready to respond at a moment’s notice to the company’s request for legal help in challenging your claim. To even the odds, you may need a lawyer.

Time is not on your side. While you’re still in your vehicle awaiting the arrival of medical help and the police, the trucking company is already beginning its own accident investigation. Unless he’s severely injured, one of the first things a driver will do after colliding with another vehicle is call the home office and report the accident. He’ll be instructed not to make any incriminating statements to investigating police officers.Meanwhile, the home office will contact its field investigators and accident reconstruction experts and direct them to the accident scene immediately. They may arrive at the scene while the state troopers dispatched to the location are still at work there. Occasionally they will arrive at the scene before the police. These representatives will photograph the accident scene, photograph the damaged vehicles, and take measurements of skid, scuff, and yaw marks and debris on the roadway while all the evidence is fresh. In the meantime, you may be fighting for your life in a local hospital.

It’s unrealistic to think the average motorist injured in an accident with a truck can get an investigator or other expert to the accident scene as quickly as a trucking company’s representatives.Nevertheless, the quicker you or a family member can engage an attorney to investigate your accident, the more likely you can gather the facts and evidence to prove the collision was the truck driver’s fault, not yours. Why? Skid and scuff marks fade with time. They can disappear altogether after a heavy rain or snowstorm. The tractor trailer may be repaired before you can get a photograph of the damage it sustained in the accident. Your own car may be towed away and sold by your own insurance company before you think to have an investigator examine it, photograph it, and put it in storage if it appears the physical evidence of damage to your car is critical to proving your case. An attorney who specializes in handling tractor trailer accident cases can conduct a complete investigation of your accident and engage expert witnesses to visit the scene, review the evidence, and determine what is necessary to win your case.

Delay and procrastination on your part are the trucking company’s friend. A delay in prosecuting your case can damage or destroy your claim in many ways. Every state has its own different statutes of limitation requiring that you file a personal injury lawsuit within a prescribed period of time. You may not be familiar with these laws.Unfortunately, if you fail to meet the specified deadline, you will be forever barred from making any monetary recovery. Of course, statutes of limitation do not apply solely to persons injured in trucking accidents. Every motor vehicle accident victim must comply with the applicable statute of limitations. In Virginia, the statute of limitations for a personal injury case is generally two years from the date of the accident. However, persons injured in a tractor trailer accident confront a multitude of additional "deadlines" which may affect the successful prosecution of their cases.

What deadlines? There are many of them.Let me review just a few. Under the Federal Motor Carrier Safety Regulations, interstate motor carriers must "systematically inspect, repair, and maintain…all motor vehicles subject to [their] control". They must maintain a "record of inspection, repairs and maintenance indicating their date and nature."FMCSR 396.3. Regrettably, these records must be maintained for only 1 year, or less if the truck leaves the motor carrier’s control.Thereafter, they may be destroyed. If you were injured in an accident caused by the improper inspection, maintenance or repair of a tractor trailer, the trucking company’s own records may provide the most important clues and evidence you need to support your claim. You want to obtain these records before they are discarded. An attorney experienced in handling tractor trailer cases will be familiar with this regulation and know how to secure the maintenance records before they are destroyed.

Every motor carrier driver must prepare a daily, written report on the truck he operated that day.The report must identify any defect or deficiency the driver has discovered or learned about which would affect the safety of the vehicle’s operation or result in its mechanical breakdown. The carrier must maintain the original inspection report and certification of repairs for only 3 months from the date the written report was prepared.FMSCR 396.11.If you were injured in an accident caused by a trucking company’s failure to correct a defect in one of its tractor trailers, you want to obtain the daily driver reports in order to determine if the trucking company was aware of the defect but made the decision not to repair it, regardless of the risk to the general public. An attorney with a tractor trailer accident practice will know to request these daily reports during the discovery phase of your case.

Motor carriers are required to maintain a driver qualification file for every driver. The file must include, among other things, a driver’s application of employment, information regarding a driver’s driving record, the medical examiner’s certificate of the driver’s physical qualification to drive a commercial motor vehicle, and a list relating to violations of motor vehicle laws. Some of these items may be removed from the file after 3 years from date of execution.FMSCR 391.51.When your lawyer obtains and reviews these documents, he may find evidence the truck driver involved in your accident had numerous prior traffic violation convictions for reckless driving or driving while intoxicated.

There are additional benefits to hiring an accomplished tractor trailer accident lawyer to represent you. He/she will be acquainted, not just with the regulations referred to above, but the myriad of other federal regulations which govern the loading, maintenance, and operation of tractor trailers.He/she can review the facts of your case to determine if a trucker’s failure to comply with safety regulations regarding brakes, lighting devices, towing methods, and emergency equipment, to name just a few, contributed to cause your accident. Were the tractor trailer’s tail lamps or headlights so obscured by dirt or by a tailboard that other drivers on the road couldn’t see them? A lawyer with years of tractor trailer litigation experience will know which questions to ask the driver and his employer during discovery depositions to elicit proof of this kind
of negligence.

When the tractor trailer operator lost control of his 80,000 pound rig and barreled into your vehicle was it because his cargo shifted? Did the trucker and/or his company ensure the tractor trailer’s cargo was properly distributed and adequately secured as specified under the regulations? Through comprehensive discovery, a well trained trucking accident lawyer may develop sufficient facts in your case to answer this question in a way that will help your case.

You may have been told the truck driver wasn’t at fault in your accident because he suddenly lost consciousness or suffered unexpected heart failure.A skilled tractor trailer accident attorney will obtain the truck driver’s medical records and learn whether the driver was an insulin dependent diabetic or whether he had a current clinical diagnosis of myocardial infarction or angina pectoris. One of these medical conditions may explain the abrupt loss of consciousness. Under the federal regulations, persons with these conditions are not qualified to operate interstate tractor trailers. Operating a tractor trailer under such circumstances violates federal regulations and may constitute actionable negligence if the medical condition contributed to cause your accident. A skilled tractor trailer lawyer will know how to develop a powerful closing argument to a jury on these facts.

Handling a personal injury case arising out of a tractor trailer accident is usually more difficult and complicated than dealing with other types of motor vehicle accident cases.Don’t let a trucking company and its insurance carrier get the upper hand. Their best interests are not aligned with yours. The less money they pay out in personal injury and wrongful death claims, the more profit they have at year’s end to distribute to their owners or shareholders. Don’t be lulled into a sense of false security when the insurance company offers to pay your initial medical bills or lost wages if only you won’t hire a lawyer to represent you. Don’t be fooled by their reassurance of help and talk of compassion for your desperate circumstances. The day will come when the money spigot stops, but by then, the critical evidence that existed to prove your personal injury case may have disappeared. Level the playing field. As soon as you or a family member is seriously injured or killed in an accident involving a tractor trailer, contact an tractor trailer accident attorney who specializes in truck accident litigation to investigate your case and give you the advice you need to safeguard you and your family’s best interests.

Truck Accident Lawyer Tips – Georgia Dump Truck / Train Collision Takes Life of Driver

A February 20 collision near Savannah, Georgia between a dump truck and two trains claimed the life of the dump truck driver. The collision occurred near the entrance to the City of Savannah’s water treatment plant in Port Wentworth, Georgia. The driver of the dump truck, Solomon Mainer, worked for a contractor removing sediment from the ponds at the treatment plant. A CSX freight train struck Mr. Mainer’s truck at the crossing. The crossing has no protective gates. The collision with the CSX train threw the dump truck into the path of an Amtrak train, which then struck the truck. The collision with the two trains broke the truck apart, causing vehicle parts to strike at least one other vehicle. Mr. Mainer tragically died at the scene of the collision. Why Do You Need A Personal Injury Attorney?

truck accident lawyer, automobile accident lawyers, automobile accident attorneysLos Angeles is famous for its movie stars, but almost equally as famous for its terrible traffic. This chronic problem is made all the more dangerous by the thousands of big-rig trucks that use the California freeways as main arteries to transport the goods coming in from ports like Long Beach and San Pedro. Notoriously crowded freeways such as the 110, the 405 and the 605 are regularly the scenes of horrific truck accidents, making a Los Angeles Truck Accident Attorney a necessity. Because of the size and scope of these heavy trucks traveling at high speeds on our freeways, the victims of these Truck Accidents – most often the occupants of the passenger cars they collide with – suffer long-term gross injuries, such as spinal chord injury, head trauma and even death. As a result, there are as many Truck Accident Lawyers in Los Angeles as there are movie stars.

Truckers, like the rest of us, are under the gun now with high gas prices guzzling up a bigger share of their profits. Big-rig drivers are in a bigger hurry to deliver their goods. The result of all this pressure? Longer hours, less sleep, and more stress. Unfortunately, this is a recipe for disaster. Truck Accidents in Los Angeles are on the rise as is the need for Truck Accident Lawyers.

road accident claim, truck crash attorneys, truck accident lawyers, motorcycle accident lawyersWe’ve all seen it: truck drivers weaving in front of us, merging over into our lane of traffic, or following too close. And on congested Los Angeles freeways, this type of reckless behavior does not leave passenger cars nearby much room to maneuver. Eighteen-wheelers pose a particularly dangerous threat on the road. Fully loaded, trucks can weigh in at more than 80,000 pounds. Stack that up against a typical family car weighing 3000 pounds or less and it’s clear why a Los Angeles Truck Accident Lawyer agrees that this type of Truck Accident constitutes one of the largest proportion of fatalities among motor vehicle accidents – one out of every nine accidents. It also produces a disproportionately high rate of gross injury. Personal Injury Attorneys in Los Angeles who specialize in Truck Accidents can attest to the fact that 78% of fatalities in these types of truck accidents were not the truck drivers themselves, but were the occupants of the other vehicle. In many cases, these other drivers were innocent victims of truck drivers’ negligence.

So what are the contributing factors to these frightening truck accident statistics?

Driver fatigue. Truck drivers are pushing their limits to deliver their goods, driving with little sleep and an extra load of stress. They’re driving faster and pushing the envelope of safety. They keep less and less distance between themselves and the passenger cars nearby.

Inexperienced truck drivers who lack training.

Driving under the influence of alcohol or drugs.

Driving too fast. Did you know that a mere 10 mph over the speed limit can nearly double the distance a truck needs to brake safely- from 315 feet to 400 feet. In wet weather, those figures practically double to 720 feet for a full stop.

Following too closely. The DMV recommends a car length for every ten miles per hour. But with big rigs measuring in at 65 feet long, you can see the stopping distance far exceeds the normal following distance we all see truckers following on the freeway.

Loss of control. Seemingly minor errors in driving that could be easily corrected in a passenger car can become fatal errors in a big rig. Over-correction, too little braking room, and heavy loads balanced on the trailer can all contribute to a disastrous truck accident.

In October of 2007, one of the worst truck accidents in California history occurred in Santa Clarita when 15 trucks converged on a tunnel known for its safety issues. But the trucks, traveling at a high rate of speed, despite the low visibility in the curve of the tunnel ahead, caused a fiery collision, multiple fatalities and many more serious injuries. Truck accident experts – as well as Personal Injury Attorneys and Truck Accident Lawyers – believe that this kind of truck accident could have been avoided if the truckers had reduced their speed going into the poorly lit, curving tunnel.

Los Angeles Personal Injury Attorneys are all too familiar with the horror stories emerging from these types of catastrophic truck accidents. Collisions involving trucks constitute 1 out of every 9 fatal motor vehicle accidents.

truck wreck lawyers, traffic accident attorneyWhile fatalities and injuries of the truckers themselves are concerning, they represent a proportionately small group of victims. Typically, in fatal truck accidents, only fifteen percent are the truckers themselves. Who suffers the most from truck accidents? People like you. Innocent people. Loved ones who did nothing more than get on the freeway to drive home.

If you or someone you love has been involved in a truck accident what can you do? Contact a Personal Injury Attorney in Los Angeles or a Los Angeles Truck Accident Lawyer who specialize in this type of Personal Injury lawsuit. They can advise you about what steps to file a Personal Injury claim, whether or not you have been injured. In one Truck Accident, the father of two children was killed in a head on semi-truck collision and was awarded $2,000,000. In another case, a man killed on a motorcycle by a big rig truck received a $4 million dollar settlement because of negligence of the truck driver. In each of these cases, being represented by an experienced and competent Los Angeles Personal Injury Attorney.
